These Terms of Service (“Terms”) govern your access to and use of the Merit Sports platform, including meritsports.ca and our mobile applications (collectively, the “Service”), operated by MERIT Sports Platform Inc. (“Merit,” “we,” “us,” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
The Service is intended for use by sports associations, leagues, teams, and their administrators, coaches, volunteers, players, and parents/guardians. If you are registering a child under the age of majority in your province, you represent that you are that child’s parent or legal guardian and are authorized to provide their information and consent on their behalf.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly at meritsports.ca/contact if you suspect unauthorized use of your account.
If you register or administer an association, league, or team on the Service, you are responsible for the personal information your organization collects from its own members (players, parents, coaches, and volunteers) through the Service, and for ensuring you have the legal right and appropriate consent to collect and use it, including under PIPEDA and any applicable provincial legislation, and under the policies of any governing sport body your organization is affiliated with (e.g. Hockey Canada or your provincial hockey association). Merit provides the platform and acts as a service provider processing that information on your organization’s behalf and in accordance with our Privacy Policy — your organization remains responsible for its own compliance obligations to its members.
Certain features of the Service, including registration fee collection and premium modules, involve payment processing through our third-party payment processor. Fees are disclosed prior to purchase or registration. Registration payments collected on behalf of an association are subject to that association’s own refund policy, not Merit’s — contact your association directly for refund requests related to program registration.
You agree not to:
The Service, including its software, design, and branding, is owned by Merit and protected by applicable intellectual property laws. Content you submit (rosters, messages, evaluations, and similar data) remains yours or your association’s; you grant Merit a license to host, store, and display it as necessary to operate the Service.
The Service is provided “as is” without warranties of any kind, express or implied. Merit does not guarantee the Service will be uninterrupted, error-free, or fully secure. Merit is not responsible for the accuracy of information entered by associations, coaches, or other users, or for decisions made by an association based on data in the Service.
To the maximum extent permitted by law, Merit will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Merit’s total liability for any claim relating to the Service is limited to the amount you or your association paid Merit in the twelve months preceding the claim.
You may stop using the Service at any time. We may suspend or terminate access to the Service for any account that violates these Terms or poses a risk to other users or the Service. An association administrator may deactivate individual accounts within their own organization at any time.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
We may update these Terms from time to time. When we make material changes, we will notify users by email or through a notice on the platform at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
